- Original plans called for about 50 stories; the 62-story design was possible with the transfer of air rights from the neighboring Seagram Building, which was approved by a narrow decision by the community board on November 10, 2005.
- Some of the concerns associated with the building were that it would diminish the views or presence of the neighboring landmark Seagram Building; however, the design was approved unanimously by the Landmarks Preservation Commission on November 22, 2005.
